"Amy Coney Barrett Sworn In" by Tanner R.

https://www.nytimes.com/2020/10/26/us/politics/senate-confirms-barrett.html

With the passing of Supreme Court Justice Ruth Bader Ginsburg it leaves a seat open in the Supreme Court. With it being this close to the election it brought even more controversy than it already would have. Democrats insisted Republicans should have waited for voters to have their say on Election Day, but Republicans believed that it was their right as the majority party to select a new supreme court justice.

The senate voted 52 to 48 to confirm the nomination of Amy Coney Barrett, and she overcame unanimous Democratic opposition. Susan Collins of Maine was the only republican who was in opposition. It was the first time in 151 years that a justice was confirmed without the support of a single member of the minority party. This shows how bitter the two sides have become.

This was a huge win for President Trump as it most likely will tip the court right for years to come. President Trump spoke very well of Judge Barrett stating that, “She is one of our nation’s most brilliant legal scholars, and she will make an outstanding justice on the highest court in our land.”

Judge Barrett has potential to make in immediate impact. There are major election disputes awaiting immediate action by the Supreme Court from the battleground states of North Carolina and Pennsylvania, which both concern the date by which absentee ballots may be accepted.

Do you wish that they would have waited to select a new supreme court justice until after the election, or do you believe that Republicans had the right to do this? Do you like the decision of Amy Coney Barrett? Please explain your reasoning.

  1. I can understood how some argue that it is the president's right to appoint an supreme court justice if one passes away like RGB did. Even though this is understandable, the timing is the main issue that many Americans have with it. She was confirmed when the election was just little over a week away. This is why many believe that this is "court-packing." Yet, the true meaning of that phrase is adding more supreme court justices, the idea coming from FDR. Many argue that it is just too close to the election and that we need to allow the newly elected president to pick since these justices serve life terms. In 2016 when supreme court justice Antonin Scalia died, the election was nine months away; yet, president Obama didn't elect a new supreme court justice.I personally believe that both sides are valid and need to be heard and respected.

  3. I honestly don't have a problem with him filling that seat as soon as possible. I can understand why he would want to fill it as quick as he did. But with some people, the way that he handled it was very strange to them.

  4. I don't particularly believe there is anything wrong with wanting to fill a seat for a supreme court justice soon after it has been opened up, but I think the issue here is with the fact that it happened so close to the election. I can see why the Republicans wanted to do this, obviously, seeing as it would move the Supreme Court some to the right. In terms of liking the decision of Amy Coney Barrett, I am kind of in the middle. While I do not agree with all of her policies, I think Barrett will bring a new perspective to the Court. According to whitehouse.gov she is the only current justice to have not gotten her law degree from Yale or Harvard, instead graduating from Notre Dame Law School in Indiana. She is also the first mother of school-aged children to become a Supreme Court Justice. Justice Barrett will certainly bring some new views into the High Court, and I am hoping they will be good. -Kirstyn

  5. I believe that it was a irrational decision, and without any support from the minority party I think it is unfair. As of now Joe Biden is the presidential elect, and I feel as if he was robbed of the option to correctly fill the seat. I do not it was a good decision made, however I understand the majority party wanting to put her in this position to tip the scale farther in their favor. I can only hope now that she does try to better our country and the United States can fairly move forward. -Hailie
