In a longstanding legal battle, the Supreme Court has ruled that a Texas inmate who has been on death row since 1980 may not be executed. The reasoning behind this ruling is that the inmate is intellectually disabled. The justices came to this conclusion in a 6-3 ruling over the case of the inmate Bobby James Moore.

Bobby James Moore is responsible for the 1980 murder of a Houston grocery store clerk. Moore shot the clerk in the head with a shotgun during a bungled robbery. It is said that in his younger years, he was called dumb and beaten by his father when he was held back twice in school and could not spell simple words at age 14. For years after the incident occurred, his lawyers argued that Moore was intellectually disabled, but the claims were rejected by Texas’ top criminal appeals courts. Even after the 2017 suggestion by the Supreme Court that Moore was intellectually disabled and could not be executed, the appeals courts still refused to accept those claims. Later, the Houston district attorney agreed that Moore should be spared the death penalty, which may result to a sentence of life in prison.

  1. I agree that an upbringing can effect a child's thinking, but he still knows right from wrong. He knew it was not okay to kill someone. Also he should have never of had a gun in the first place.

  2. This is a prime example of the brokenness of the U.S's justice system today; the way to fix this is by focusing on rehabilitation and restoration rather than punishment.
    As reported on The Hill by Republican Representative of North Carolina Mark Walker: "taxpayers spend more than $70 billion [dollars] each year to incarcerate 1 in 100 American adults."

We need to stop the vicious cycle of recidivism and abolish barbaric punishments like the death penalty.This is the way to fix our broken justice system in the United States of America.

  3. Regardless of whether or not he is intellectually disabled, which I believe he isn't, he still knew that murder is wrong. There are toddlers that know murder is wrong. He also knew to run after killing the clerk, because he knew what he did would get him in trouble. I also read that he was given an IQ test, which he scored a 74 on. A IQ of 70 classifies someone as intellectually challenged, so Moore is not intellectually challenged. I would have to read more on the case to make a better decision, but from what I know now, I think he deserves the death penalty.

  4. Everybody knows that murder is wrong, whether they have a disability or not. He knew he was in the wrong when he shot the clerk. His childhood may have had a very negative impact on him, but he shouldn't have done what he did.

  5. I think he deserves that sentence. I feel like he should get the death penalty for what he did, it does not matter if he is intellectually disabled, he was taught that somehow, and took his knowledge and used it.Just because your father "beats you" and you dont know how to spell simple words, doesn't make you unstable from your state of mind. You are able to be taught overtime how to spell, and you dont have stay in that home so you would be able to better yourself overtime. Its just really pulling "My father beats me, and I dont know how to spell, but I know how to shoot a gun" Card. Kill em', I feel like if you killed, raped, or something else really out there kind of things, you should be placed on death role.
